General Terms and Conditions – Eleanor & Grace Boutique
Article 1 – Definitions
The following definitions apply to these General Terms and Conditions:
Withdrawal Period
The period during which the consumer may exercise the right to withdraw from the contract.
Consumer
A natural person who is not acting for purposes related to their trade, business, or profession and who enters into a distance contract with the business.
Continuous Contract
A distance contract relating to the regular supply of goods or services over a defined period.
Right of Withdrawal
The legal right of the consumer to withdraw from a distance contract within the applicable withdrawal period.
Business
The natural or legal person offering products or services to consumers via distance selling.
Distance Contract
A contract concluded between the business and the consumer through one or more distance communication methods.
CESOP
The Central Electronic System of Payment Information introduced by the European Union for monitoring payment service providers.

Article 3 – Scope of Application
These General Terms and Conditions apply to all offers made by Eleanor & Grace Boutique and to all distance contracts concluded between the business and the consumer.
Prior to the conclusion of a contract, these terms are made available electronically in a way that allows the consumer to store and review them.
Article 4 – Offers
All offers are non-binding and subject to change. Eleanor & Grace Boutique reserves the right to modify or withdraw offers at any time.
Each offer clearly states the total price, including applicable taxes, shipping costs, and any additional charges, unless stated otherwise.
Article 5 – The Agreement
A contract is concluded at the moment the consumer accepts the offer and fulfills the stated conditions.
After placing an order, the consumer will receive an order confirmation by email without undue delay.
Article 6 – Right of Withdrawal
The consumer has the right to withdraw from the contract within 14 days of receiving the product, without providing any reason.
To exercise this right, the consumer must notify Eleanor & Grace Boutique in writing within the withdrawal period.
Article 7 – Costs in Case of Withdrawal
If the consumer exercises the right of withdrawal correctly, Eleanor & Grace Boutique will refund all payments received, excluding return shipping costs, within 14 days of receiving the returned product.
Returned items must be unused, undamaged, and in their original packaging.
Article 8 – Customs, Import Duties & Taxes
For orders shipped outside the United States, the customer is solely responsible for complying with all import regulations, including customs duties, taxes, and clearance fees.
Eleanor & Grace Boutique is not the official importer of record for international shipments.
Any additional charges imposed by postal services, courier companies, or customs authorities are the responsibility of the customer. Failure to comply with import regulations does not constitute grounds for cancellation or refund.
Article 9 – CESOP Compliance
In accordance with European Union regulations effective from 2024, payment service providers may be required to register certain transaction data in the CESOP system.
Eleanor & Grace Boutique complies with all applicable reporting obligations where required.
Article 10 – Compliance & Warranty
Eleanor & Grace Boutique guarantees that delivered products conform to the agreement and applicable legal standards.
Any complaints regarding defects or non-conformity must be submitted in writing within 14 days of receiving the product. Returned items must be unused and in original condition.
Article 11 – Delivery
Orders are delivered within 30 days, unless otherwise agreed.
In the event of unforeseen delays, the customer will be informed within 14 days after placing the order.
Orders are shipped in the customer’s name and at their legal risk regarding import obligations.
Article 12 – Complaints
Complaints must be submitted in writing within 7 days after the issue is discovered.
Eleanor & Grace Boutique will respond within 14 days. If additional handling time is required, the customer will receive an estimated resolution timeframe.
Article 13 – Governing Law & Disputes
These General Terms and Conditions are governed by the laws of the United States.
Any disputes will first be addressed through mutual consultation. If no resolution is reached, the dispute shall be submitted to the competent court in New York City, USA.
